100%. The sad fact is that neither side the R's or D's- have done fuck all in Congress to curtail spending and to root out waste, fraud, and abuse. Congress has abdicated it's power and authority for decades and has just handed more and more of it's own powers to executive branch over the years. just look at the war machine.....executive was never intended to have these kind of powers as it relates to war. Constitution is clear as day- Congress has sole power to declare war- there can be no war without Congress making a declaration of war- yet we fight 'em constantly with no such declaration. Congress are by and large sad sack of useless shits.
I believe the War Powers Resolution (or something like that....whatever it's called) allows the president to initiate military action for like 48 hours before he has to explain himself to Congress, who can then call the dogs off.
1) you'll want to check that. I'm relying on some Civics lessons from a lot of years ago and I could be totally wrong
2) somebody with clearer legal understanding would still need to check that, even if I'm right
3) if correct, it would seem that only Congress can declare war, but that the president can basically start a war without declaring. At which point, I guess, Congress' hand is either forced, or they tell him him screw you, stop doing what you're doing.
