Why is this a new thread? The conversation is mostly over, but better to have the same conversation be done in one place than in two.
couldn't find the old thread. And this is a new development. Zach was on twitter basically claiming Herman is a drug addict who constantly cheats on his wife. Just like Zach. Probably drinking buds.

It's exactly why I don't do twatter or FacePlace.So much of social media/internet has turned into vitriol and malevolence,smear campaigns and character assassination.Go have a beer and a belly laugh and stay away from Zach and strip clubs or Herman and massage parlors or anything McDouche writes
It can be. But to some extent that's more about the people we look at and the people we are. If we think the world is kind, we'll never find a shortage of examples. If we think its malevolent, ditto. That's born both of our perspective and our circles of friends.

McMurphy on Columbus Radio admits his only goal is to get Meyer fired.
"If they would just fire Meyer, then isn't a story I need to write."

Meyer on a sound bite says he is talking with University Lawyers to see if there is a defamation of character lawsuit possibility.

I think McMurphy has crossed what ever journalistic integrity line there is. 

ESPN talking head of all people just said "Shame on The Athletic for printing such garbage."

The "knowingly false" standard makes most defamation trials proceedings dead on arrival. And unless McMurphy has subpoenable documents saying "I know it's false, colleague, but I'm on a vendetta to get him," there's no way Meyer's lawyers will humor this string of though UNLESS they want to intimidate McMurphy with the idea of defamation and think it'll work even if the trial can't succeed.

They may have a case people are sick of that shit.I haven't been the biggest supporter of Urban but that's yellow journalism on full display.Taking someone's slanderous story and running with it and presenting it as fact is incompetence - ignorance of the law is no excuse.Maybe we should ask ELA,MH or Max Sam

If McMurphy either *thinks* it *may* be true, OR knows it isn't true but there is no subpoenable proof of that ... then defamation success is essentially impossible.
For Meyer's lawyers to succeed, they'd need BOTH for McMurphy to have *known* this is absolutely untrue and for evidence of his knowledge to be findable by them.
That's why defamation suits are so difficult. It's an enormous burden to prove. For either of two reasons, Meyer's lawyers realistically have no chance.

according to you,it's legal malpractice I hope they go for it.They have witnesses to the actual incident who call bullshit.That would carry weight if I sat on a jury

No not legal malpractice. I'm just talking about defamation. To succeed you need to PROVE both things:
  • that McMurphy KNEW (not thought, not wondered, not waffled, but KNEW WITH CERTAINTY) the claim was untrue
  • that McMurphy intended harm and be able to PROVE that intent
Both are so hard to accomplish legally. And in this case we likely cannot possibly pass step one.
How would you prove that there's a 0.0000% chance that McMurphy didn't know this wasn't true?

I'm not even defending McMurphy, btw. Whenever anyone hears the word "Defamation," they should almost always respond with "Ha, well that's never happening."
The ratio of times used to times succeeded for that word probably approaches more than one million to one.
