There isn't much a judge can do at this point presuming the indictment is accurate and shows reasonable cause.

I remain entirely in favor of due process in the US.

It's a legal requirement for everyone in the US.  "Due process" means different things depending on your status.  It can be pretty brief if you are undocumented.

Congress defines "due process" according to the Constitution, and they have for example immigration courts to handle immigration issues.

Correct.

But - Illegals who failed to check in on their way here deserve nothing. They have not technically entered the country. The SCOTUS has back this stance in prior cases.

Individuals with a deportation order already received their due process. Time to go.

The illegals here do merit due process, it can be brief, but it certainly exists.

Those caught within a certain distance of the border can be sent back immediately.  That is the lone exception I think.

Under the expedited removal process, immigrants who have been in the country illegally for less than two years and are apprehended within 100 miles of the border can be deported almost immediately without going through a court hearing.

The exception is asylum seekers, who must be granted a hearing.

I have mixed feelings about “due process.”

It is an extremely important part of our system.  I believe strongly in the concept.  

But the term “ due process “ is so misused and overused.   For some- the translation is “ screw the law, I can use the attorneys and courts to delay a just conclusion forever .”

And once it is clear that there is guilt- we will use due processes to delay any punishment for a long time.  

Do convicted criminals have more rights than victims?  It is a fair question.  

Lastly- if it is crystal clear a person came in illegally or is here illegally- why do we have to allow on over abundance “due process” to delay their deportation?
