yeah I know they brought that case, now let's see them present the evidence at trial and convict him before we say he's guilty of anything.
They're trying to. Sometimes the legal process doesn't play out quickly, which is why we're nearly a year from the charges being filed and yet the case hasn't started. And now the lower court has to rule on whether the acts in question were "official acts" before the trial can even proceed.
It's unlikely there will be a trial before the election, so we won't get a chance to hear the evidence and have the case decided.
As usual, Trump will get a free pass.
and that's not exactly all they tried to do...tried blowing January 6 up into something it obviously wasn't and tried pinning that on Trump- which is ridiculous. they tried countless other obvious bullshit trumped up cases in civil, state, and federal courts that should've never been brought- which is ridiculous. And federal cases often take several years to go to trial....hardly see how anyone can blame that all on Trump.
I'm not versed enough in legal matters to know whether he's legally culpable for incitement, as I said upthread. However IMHO Trump absolutely has
moral culpability for what happened on Jan 6.
Trump's lawyers can try to say and argue anything...and the SCOTUS' decision about Presidential immunity didn't state a President has complete immunity from all prosecution. That is not what the decision stated at all.
I'm aware of what the decision stated. And now his sentencing in the hush money case has been delayed, not because of any new evidence that might overturn his conviction, but because SCOTUS says that "official acts" are granted immunity,
AND further that any evidence that is uncovered that is related to official acts is inadmissible.
So now the judge has to look at a conviction for acts (sex + hush money payment) that occurred prior to Trump's election, and couldn't be termed "official acts" in any possible sense of the word, might have to be overturned if any of the evidence presented at the trial was uncovered during/from "official acts" after he was inaugurated.
Which makes it increasingly likely that Trump will get a free pass.
