Anyone convicted of a gun crime should not be able to legally purchase a gun. My general opinion of course, as a lawful gun owner.
He was convicted of a paperwork crime. He took a gun he owned legally in a car he owned legally. But he lives in a place where having a gun you own legally in a place people can’t see is a crime without the proper government paperwork.

It’s a crime that would carry no jail time for him, just paperwork. And it was pled down to a crime that carried no jail time, just paperwork and a requirement to be in good behavior, both of which he completed.

Like, I don’t have strong feelings one way or the other. But if that’s cause to strip your second amendment rights, that’s a weak second amendment and strong gun control laws.

I’m a little confused by this. Are you saying this applies in this situation, or just a general thought?

What I meant was, is he arguing that this person should be stripped of said rights as a convicted felon?

Because him not being a convicted felon would complicate that.

Again, it's complicated. The man committed a gun crime he and was charged with a felony. That charge was reduced in a plea deal.

Yes. But in this country, things (ideally) are decided by what you are actually convicted of.

And the “gun crime” is not having a government permission slip. Didn’t shoot anyone. Didn’t threaten anyone. Just had his property on his person in a manner the government deems problematic.

I mean. If we want to drastically expand the set of situations where the government can limit firearm possession, I suppose that’s a chat we could have. I just didn’t expect it to align like this.

Perhaps the prosecutor & judge should have done some homework and realized this guy could be dangerous and not have taken the plea?

Because the government doesn’t want you carrying your gun non-visibly unless they let you do so. 

Interestingly, other states basically outlaw open carry in the vast majority of cases.

Even if they didn’t, he wouldn’t have served any jail time. And it’s not super likely he’d be barred from firearm possession. 

Again, that law has a range of outcomes. And most of the bad ones only apply to repeat offenders. 

What homework would they have done?
