That is decidedly not how this works.

If this simply wasn’t an insurrection, the court could clearly and narrowly define an “insurrection” in a 14th amendment context and say this wasn’t it. Would’ve been easy.

Instead, we catch this kind of knotty thing that limits the power of states. I guess there’s certain value in handing that kind of thing over to the federal government. It does lead to some oddities (states have long had some hand in this kind of thing, but apparently that was illusory or wrong).

But at a point, it is what it is.

The "Let's Go Brandon" thing is just dumb. 

It would be one thing if it was Biden who was saying that's what a crowd was chanting. It would be another if it was a Democrat or even a left-leaning media member saying that's what a crowd was chanting. Then it would be dunking on Biden / the left. 

But it's not. It's a goddamn NASCAR reporter playing to a (likely mostly conservative) NASCAR viewing audience trying to deflect and thinking she was clever because a guy named Brandon won the race. 

It's not clever. It's not funny. It's not even mocking Biden or the left because they were completely uninvolved in it. 

I'd tell people that use it "you can do better", but I'm not sure they can...

Not "everybody".  Clearly quite a few folks "know" it was an insurrection.  As with most things today, it's in the eye of the beholder.  (I personally am not concerned with what to call the thing, I'll leave that for the courts or jurists to define.)
