Yeah, I mean, without some of the details to pick over, it seems like a case of SOP.

Most charges are pled down
. In that case, it doesn’t seem like there was a ton of reason to pick the guy out for different treatment three years ago. The felony he committed is logically only a felony because of a pretty heavy gun control approach. If we were more aggressive in that kind of thing, I’m betting it ends in a notable limitation of firearm rights, which maybe is an outcome we want.
And I think sometimes the charges as filed are merely the first point in the prosecution's negotiation. And in most negotiations, you often start out with more than you think you can get in order to hope that you end up getting what you really want.

This is true. Though probably not applicable in this case.

There’s also a question of the “felony” element. As we’ve talked about, a felony comes with considerable life burdens. You’d hope that we as a society would be judicious with such a thing.

Most people who catch this charge on the first try probably don’t end up shooting you a lot of people. It’s probably a better social outcome for their lives not to be significantly impaired going forward, even if the outlier gets missed.

maritime law is some tricky stuff- and disallows things you'd think obvious when it comes to defense.

an logistics outfit who regularly sailed around the horn of Africa was trying to hire guys of my ilk (at the time) to provide security against pirates... their intended tactics were highly illegal and so was the weaponry... and if there was conflict 'we' would have been on our own insofar as legally- but the pay was off the charts high compared to any other private defense contractor stuff- and this was when Afghanistan and Iraq were in full swing- and you were only onboard those vessels for a brief portion of their passing.  If i recall what happened clearly, they ended up hiring a russian outfit... the penalty for error was too much for American guys to do it- engaging pirates wasn't the problem.. facing int'l maritime law after the fact, was.
