‘QAnon shaman’ Jacob Chansley is sentenced to 41 months in prison- POLITICO

Nonbinding federal sentencing guidelines called for between 41 and 51 months in prison for Chansley on the felony obstruction count he pleaded guilty to.
Watkins asked in a written pleading that Chansley receive a sentence “significantly below” that range, but prosecutors urged Lamberth to impose a sentence at the top end of that range, 51 months. They rejected arguments that he was a “peaceful” participant in the Jan. 6 mob.
“If the defendant had been peaceful on that day, Your Honor, we would not be here,” Assistant U.S. Attorney Kimberly Paschall said.


Was the sentence "fair"?  I don't know enough about the case to venture a guess other than it seems harsh in general.  But he did plead guilty, and the judge gave him the lowest sentence in the guidelines.

I recall some of the Jan 6 folks sentenced plea bargained and accepted their sentences.


That's usually the case. 

I'd venture that the vast majority of the folks involved in all that got punished somewhat in line with how things usually go. Probably on the lighter side of most federal defendants because most didn't do anything notably violent or possess large quantities of illegal substances or something. Some also probably complicated things by acting unsocialized and insisting their lawyers say they didn't recognize the court's authority or mouthing off on social media/text that they were there to do violence. 

And then there's the fact that when most people actually observe the mechanics of the criminal justice system was it relates to someone they don't want to see thrown away for years by default, they're struck by how Byzantine and unfair the whole thing is. Plus you have screamers on both sides, shading in the edges by explaining this is a travesty of justice, either becuase it was far too harsh or far too lenient.

#1 – Immigration
You probably wouldn’t expect it, but immigration remains the most common federal crime charged by the U.S. Attorney every year. According to statistics from the 2018 fiscal year 2018, the U.S. Sentencing Commission keeps track of federal convictions and charges. According to their report, released in June 2019, immigration crimes make up 34.4% of all federal crimes.
#2 – Drug Crimes 
While this is a broad category, the fact is drugs accounted for 28.1% of all federal charges brought against defendants in 2018. This includes everything from possession to delivery and trafficking. In the federal court system, even minor possession of drugs can become a federal offense if it is committed on federal property or if there is transportation across state lines.
#3 – Firearms 
The third most common category of federal crimes involves guns. Because there is an entire federal agency devoted to tracking down illegal arms dealing and firearms crimes, this should come as little surprise. The Bureau of Alcohol Tobacco and Firearms (ATF) arrests. With more than 2,500 agents, the ATF brought over 7,000 cases to prosecution in 2019 alone.
#4 – Fraud/Theft/Embezzlement 
This category of crimes includes everything from employees who conspire to defraud and steal from national corporations to people engaged in illegal scams that may be done online or across state borders.
#5 – Sex Crimes 
Though the report separately classifies child pornography and sexual abuse, there is another category for “other crimes” which makes up 9.2% of all crimes. Many of these are sex-related crimes as well. Sex crimes in general account for a significant portion of federal indictments, roughly 3-5%.

As we all know- that riot was openly being encouraged by high ranking members of a political party as well as mainstream media. In fact- it was being celebrated- and those causing the violence at OUR White House were being made to look like victims, when the national guard took steps to defend themselves.

This is something I do not have the answer to. One would assume some. 

I do remain impressed by the depth of our tribal nature in all this. It's an act that if ideologies didn't align would have folks on this board calling for folks to be shot. But when they do, here we are.

(I find myself torn about what I think should happen to those folks. On one hand it is a house of the people, and if we can separate what it means from it just being an office building, probably fine to consider it just property. On the other, if you roll in with the threat of violence to stop the democratic process, I do take a dim view of that, and in a vacuum, most of society does as well)

for the record, I do not support riots of any sort. That includes January 6. It should have never happened, and hopefully will never happen again.

But, it probably will.

The six number comes from the secret service, which to a degree makes sense. They're not a big outfit focused on arrests, and it sounds like they didn't engage folks until after it quieted down, to a degree.

I think most people here, from what I can ascertain, just want perpetrators of any violence to be discouraged and prosecuted regardless of the cause.  And you have to be honest with yourself and admit that that has not been the case.

Yet there were still 300 arrests made per bab's link.  Seems like that's a pretty ripe pool for prosecutions, should one choose to follow through on such activity.
