The NCAA and its five power conferences have approved a proposed multibillion-dollar antitrust settlement that would allow schools to directly pay players for the first time.

In the spring of 2021, attorneys for the NCAA, appearing before the U.S. Supreme Court, argued vehemently against providing each college athlete with additional cash annually.

The amount: $5,980.

Three years later, in a landmark agreement that will transform the course of major college athletics, the organization left behind its archaic rules, shook off its long-time amateurism argument and thrust the industry into an era of direct athlete compensation.

The amount: more than $15 billion in new cash is expected to funnel to athletes over the duration of the 10-year agreement.

The NCAA and power conferences cast votes this week in support of settling three antitrust cases (House, Hubbard and Carter), approving terms that feature nearly $2.8 billion in back damages; a future athlete revenue-sharing model that will cost major conferences a cumulative $1 billion-plus annually; and other potential changes to the association’s governance, enforcement and scholarship structure.

While expected for weeks now, the vote is a historic moment, a groundbreaking and seismic shift for an organization that has, for decades, fought against direct athlete pay despite the billions earned from its major football and men’s basketball powers. The result of nine months of negotiations with plaintiff lawyers, NCAA president Charlie Baker and conference commissioners usher into the industry a new age that they hope brings stability to the current unruly recruiting landscape.

Caught in a purgatory between amateurism and professionalism, major college sports is springing forward — though not by its own volition. Begrudgingly forced into this semi-professional world by state laws and the court system, the industry still clings to a shred of amateurism, as the new model is expected to still prohibit pay-for-play and booster payments.

However, college leaders believe the agreement staves off future legal challenges, binds at least for another decade the power leagues with the NCAA, and brings more regulation to the recruiting environment.

“This would be the biggest change in the history of college sports. Period,” said Gabe Feldman, a sports law professor at Tulane and leading voice in NCAA litigation matters. “There have been significant changes and incremental changes. The NIL era has opened a lot of doors, but to have athletes share revenue with the schools would be not only monumental but would be contrary to what the NCAA has espoused for a century.”

I'm pretty confident that's how the world functions.  Although I think the handful of people who run the world do the handshake before putting things into motion rather than as a conclusion.

I mean, there is nothing wrong with a handshake deal, but they work only when both parties are generally aware of the expectations and benefits of the arrangement. Contracts exist for a reason, and the reason is to spell out what everyone is expected to do and expected to get. The current arrangement in college football motivates parties to not know what everyone is supposed to get nor what they are supposed to do.

A lawyer once told me a patent can only be as good as the will to enforce it.  It's a kind of contract.  He's a bit over stating it, but he's also right.

A contract is only as good as your will to enforce it.  A handshake agreement where both sides have a clear incentive to abide is probably better, stronger.  A handshake where both parties trust the other and understand there will be more in the future is also pretty strong.  

I've also reviewed contracts that were poorly worded and vague or left out key points that were next to worthless.  And yes, I reviewed a fair number back in the day.  If they delved into technical issues at all, the lawyers were pretty much out of their depth.

I wish I knew who this "handful of people who run the world" were.  They aren't doing a very good job.  Is Biden one of them?

If indeed a handful of people (which I presume is a number fewer than 20) are "running the world", someone should be able to provide a decent list.

I could see having Putin and Xi on said list as they are almost dictators.  The other known national leaders are either insiginificant or lack unitary powers.  Macron?

Maybe it's that Tripartite Commission or some such, or the Catholic Church, or the zillionaires, or some secret cabal that we don't know about at all ...

I have known a few folks in life who truly thought some secret group of a handful of folks ran everything in the world, or nearly so.  They were SO secret I of course didn't know about them, but the folks did, and would enlighten me.  They used various terms, depending on the folk:

The Bilderbergs were popular.
Masons of course.
The Pope et al.
Club of Rome.
Some folks in some forest somewhere.
The Rothchilds (who make pretty good wine anyway)
The Group of Five, or Four, or Seven, depending.
Bill Gates and Warren Buffett (the latter of course made his money on serve yourself restaurant places)
