I have a hard time believing it was an accident,someone slipped in a live round somewhere along the line.Who ever gave the so called prop to Baldwin was either incompetent or complicit. So Baldwin maybe an accessory could plead ignorance unless he was directed to go and procure the "Blanks"

Is a prop gun an actual firearm?  Not supposed to be.

Unless threr is some law saying its the actor's responsibility to verify the gun is not real I agree and never understood how he could be charged

Obviously, this one was, and they often are, just using special ammunition (supposedly).  One story was that the crew were messing around with this firearm and actually shooting it somewhere near the set with live ammo.  The armorer was found guilty of negligence.  Maybe it was an accident, but an accident can comprise negligence, and be criminal.

And this movie star is still liable in civil court of course should the family go that way.

A combo of an overzealous prosecutor and him making the mistake of talking to cops/publicly. 

Then the overzealous prosecutor and a rare judge with a sense for rights ended things.

Baldwin’s attorneys accused the state of misconduct, pointing to a batch of unexamined bullets that a potential witness turned over to sheriff’s investigators months ago. New Mexico 1st Judicial District Court Judge Mary Marlowe Sommer appeared furious over the handling of the evidence, which was not given to the defense.

“Rust” is set in the 1880s and according to Hall, when period weapons are used “you have to use actual historic period weapons and to check the safety of those weapons. I have known live rounds to be fired out of revolvers, certainly, to make sure that they do function in a way that when you put a blank in, it isn’t going to blow up or explode in the actor’s hands.”

The weapons master is required to be on set whenever a weapon is being used. The Actors’ Equity Association’s guidelines state that, “Before each use, make sure the gun has been test-fired off stage and then ask to test fire it yourself. Watch the prop master check the cylinders and barrel to be sure no foreign object or dummy bullet has become lodged inside.” Further, “All loading of firearms must be done by the property master, armorer or experienced persons working under their direct supervision.”

It was good to see a Brady violation taken seriously. A win for individual rights vs the government.
