If you do it in a profanity-laden, spittle-flying way, yep, pretty much. 

Just about no one feels like coming together as a nation because someone dog cussed them for fun. Fixing divisions is going to take someone saying "That was a terrible thing to say, but I'll work to respond calmly." And it's understandable people don't want to do that and are content widening divisions.

Possibly. Again, some things that are protected speech are capped for various reasons in those settings. One could argue this is a political statement, which maybe would be covered. 

Like, you could get in trouble for mocking a fat or bulimic person's weight, one student to another. That is most likely protected speech in a first amendment sense, but in some ways capped. Now, if these possible taunts were cast as a political statement, those tend to get more protection. 

But in the end, it shouldn't come to any of that. Even before we talk first amendment, a sexual assault investigation (I'm not totally clear on if "charges" are being used in an official sense or colloquially) is an absolutely ridiculous response to this, unless someone is lying. Even more basic than the question of constitutionally protected speech is that this simply is in no way sexual harassment, even if it wasn't protected.

You're right. I shouldn't have said that. I let someone who wanted to deepen the divisions in our country get the better of me. (Also, that someone was admittedly trolling for a response)

That's a college, not a middle school (protections for college professors are extremely broad). And it was cast as part of a political statement, which I noted could be part of a case arguing for it.

sorry but as I previously said when the school ramped up sexual harassment charges against these kids it took the situation to a much higher level

yes the 1st amendment does apply here even though its kids involved

Again, we absolutely 175% agree about the middle portion. So we don't need to go over that part.

Now, I've not said I'm 100% sure the first amendment doesn't apply here, but I think it's a gray area, at least until the courts clarify it. We also know, and I think can agree, that there are some things students are not allowed to say in levels of K-12 settings. For example, you can't cuss out a teacher nor loudly say something lewd about a classmate, or slinging around racial slurs without the risk of some kind of consequence (but all these things are first amendment protected in the vast majority of situations). Teachers are allowed to levy some punishment for what's deemed disruptive behavior.

Again, we agree to the hilt that this consequence it wholly gross and terrible, and the people levying it should be shamed. But I'm not sure, at least at this point, if whatever is alleged could possibly fall under the disruptive category. (And to take it to another level of agreement, if the parents' story is true, the school should also be able to level some type of discipline on the person with the pronouns for flipping shit at some kid. )

Edit: There could be a compelled speech argument, the same principle why you can’t make kids say the pledge of allegiance. That was again cast as a political matter, but perhaps this will be too.
