Due process is granted even to folks who didn't somehow seek it.  A robber didn't seek due process in the process but he's due it when charged with the crime.

The Constitution seems pretty clear on that point.

I don't think ANY Amendment could pass at the moment, on any topic.  I know some folks L and R call for a Convention of the States, that could happen, maybe, someday, it might not produce the desired results.
