It's certainly fair game to point out in an election. Don't vote for the person who has her own email server. But what it wasn't was a crime, it never was a crime it was ridiculous to treat it as a crime, and it is absolutely an example of the Swamp doing it's own thing and subverting elections.

As far as comparing those two situations, that is a no brainer. 45 wouldn't give the files back and hid them and lied about (allegedly). As opposed to just having them in 46's case.
