Biden’s Gun Policy Could Tax Gun Owners $200 for Every ‘High-Capacity’

Democrat presidential nominee Joe Biden’s proposed gun control policy includes a provision that could require Americans to sell back their so-called “high-capacity magazines” to the government or be registered under the National Firearms Act of 1934 (NFA). The latter, unless there were some form of carve-out, could mandate that American gun owners pay a $200 federal tax for every high-capacity magazine they currently own.

In addition to the $200 tax, owners of high-capacity magazines under Biden’s view of the NFA, could also be required to register them with federal authorities, submit their fingerprints and photograph, and potentially submit to an FBI background check.

ll of this is detailed on Biden’s campaign website, which states in bullet-point form (emphasis in original):

Regulate possession of existing assault weapons under the National Firearms Act. Currently, the National Firearms Act requires individuals possessing machine-guns, silencers, and short-barreled rifles to undergo a background check and register those weapons with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Due to these requirements, such weapons are rarely used in crimes. As president, Biden will pursue legislation to regulate possession of existing assault weapons under the National Firearms Act.

Buy back the assault weapons and high-capacity magazines already in our communities. Biden will also institute a program to buy back weapons of war currently on our streets. This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act.

As Breitbart previously reported, it could also be mandated that so-called “assault weapons” such as the AR-15 be registered under the NFA if these policies were lawfully enacted.  Theoretically, this could mean that if a gun owner has already purchased one AR-15 and five high-capacity magazines, the owner could be required to pay $1200 in federal taxes, assuming he or she does not participate in any proposed buy back program.

The above paragraph on Biden’s website links to a memorandum from former Congresswoman Gabrielle Giffords’ Giffords Law Center that also calls for the regulation of “assault weapons” under the National Firearms Act.

The Giffords’ memorandum notes:

The NFA, enacted in 1934, was the first federal regulation of the manufacture and transfer of firearms. Machine guns, short-barreled rifles, and silencers are currently regulated under the NFA. In order to possess NFA firearms, individuals must undergo a background check process that includes the submission of photo identification and fingerprints and requires the registration of the firearm with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Individuals must also pay a $200 transfer tax, an amount that has not changed since the NFA was established in 1934.

The Giffords’ memorandum then calls for the policy that the Biden campaign website also endorses: “Giffords proposes that Congress require all existing assault weapons to be regulated under the National Firearms Act.”

The Giffords’ memorandum specifically defines “assault weapons” to include the AR-15. As noted, if lawfully enacted, this policy could encompass “existing assault weapons.” In practice, this could mean every American who owns a weapon like an AR-15 — or any other gun deemed by Democrats to be an “assault weapon” — could be required to submit their fingerprints and photograph, undergo an FBI background check, register these weapons with the ATF, and pay the federal government a $200 tax for each weapon. These requirements could also apply for all “high-capacity magazines” a gun owner possesses, assuming the gun owner chooses not to participate in any proposed buy back program.

The exact definition of a so-called “high-capacity magazine” is open to some interpretation. The now expired 1994 Federal Assault Weapons Ban defined a “large capacity ammunition feeding device” as a device providing more than 10 rounds of ammunition. The Giffords Law Center, which the Biden campaign linked to for its gun control policy, also defines “large capacity” as anything over 10 rounds. “Although the statutory definitions vary, magazines with a capacity of more than 10 rounds of ammunition are generally considered ‘large capacity’ magazines,” Giffords Law Center notes.

In 2018, the state of Vermont enacted gun control legislation limiting rifle-magazines to 10 rounds of ammunition and handgun magazines to 15 rounds of ammunition.

Joe Biden has been unspecific about his own definition of the exact number of rounds constituting a high-capacity magazine. Last year, for example, he decried the existence of “magazines that can hold multiple bullets in them.”

“The idea that we don’t have elimination of assault-type weapons, magazines that can hold multiple bullets in them. It’s absolutely mindless. It is no violation of the Second Amendment. It is just a bow to special interests of the gun manufacturers and the NRA,” Biden said in September 2019.


The phrase “magazines that can hold multiple bullets” could imply anything over a single round.

“Allowing a Biden administration to redefine standard capacity magazines in such a way whereby they would legally fall within the National Firearms Act would be quite scary and shocking to gun owners and to all who value the Second Amendment’s individual right to keep and bear arms,” said attorney Mark W. Smith, a presidential scholar and senior fellow at the King’s College in New York City.

“It is unclear whether Biden would limit the types of magazines covered under a reimagined NFA to only those magazines that are attachable and detachable to long guns such as semi-automatic rifles,” Smith explained. “If a Biden administration went down the road of trying to rewrite the NFA through legislation or otherwise, then it would certainly be possible that they could argue that any and all magazines with a capacity to hold 10 or more rounds, or some other arbitrary number of rounds, must be registered under the terms of the NFA, and this would potentially include magazines that are attachable and detachable to ordinary semi-automatic handguns such as 9mm pistols and the like. In other words, why wouldn’t a Biden administration try to include handgun magazines in addition to rifle magazines under the NFA, if they could get away with it?”

Smith concluded, “When it comes to legal overreach, I am confident‎ that a Biden administration would go all in on their efforts to disarm Americans.”

In an interview last year with CNN’s Anderson Cooper, Biden seemed to confirm his intention to disarm at least some Americans.

Cooper asked him, “So, to gun owners out there who say, well, a Biden administration means they’re going to come for guns?”

Biden responded, “Bingo. You’re right, if you have an ‘assault weapon.’ The fact of the matter is they should be illegal, period.”

Firearm Sales Heading Toward 20 Million Guns in 2020

More guns have sold this year than ever before, and there are three months to go. The number of firearm purchases reflected by National Instant Criminal Background System (NICS) checks the FBI performed Jan. 1 through Sept. 30 reflects an all-time record, according to findings released by Small Arms Analytics & Forecasting (SAAF) last weekend.

“The 2020 year-to-date sales (January to September) now stand at 16.7 million and thereby exceed the previous annual high (January to December) set in 2016 with 16.6 million units sold,” SAAF Chief Economist Jurgen Brauer said in the news release. Volume for 2020 had already eclipsed 2019’s total by August.

For the month of September the organization found the number of firearm sales that resulted in a background check came in at roughly 1.8 million, which represents a 66 percent increase over the same period in 2019. Handgun sales led the way at .98 million.
The National Shooting Sports Foundation’s findings were slightly more conservative. It estimated total sales in September were roughly 16.1 million. While NICS serves as a barometer for total sales, precise numbers are not possible due to its comingling with other administrative use of the system.

It also processes and checks the status of many with concealed carry permits as well as performing other routine administrative duties. In addition, some regions of the country do not require law-abiding citizens with a valid carry permit to undergo a redundant background check when purchasing a firearm.

With the traditionally heavy holiday sales months of November and December on the horizon—as well as the contentious Presidential election in November—speculation already widely circulates that a figure of 20 million will be reached by Dec. 31.
Whether the once-unimaginable mark is possible or not may, however, be determined by ability of manufacturers to keep supply lines filled. In addition, Brauer noted while monthly sales improvement remains significant the pace’s acceleration has slowed. “…[T]he August and September in 2020 increases are the lowest since March 2020,” he said.

Michael Matthews, manager of the Virginia State Police’s Firearms Transaction Center, told The Free Lance–Star that 587,107 background checks were conducted in just the first nine months of 2020. “This is more than our previous highest year, which was 2016, with 505,722 transactions for the entire year,” he noted.

The General Assembly’s action would have been considered a rousing success if the goal was to increase, rather than decrease, the number of firearms in the commonwealth. But since there are now more than a half million more of these weapons in Virginia than there were before the Democrats’ highly-touted gun control bills passed, one can only conclude that the effort was a total flop.

Who would have guessed that Democrats in Richmond would be better at increasing gun sales in Virginia to record levels than the NRA?

“Joe Biden openly admitted his plan to violate our Second Amendment rights,” points out a new video from President Donald Trump’s reelection campaign, released on Oct 12. 
That reminder may be necessary. As the 2020 election draws ever closer, Joe Biden and Kamala Harris have almost entirely stopped talking about their plans to strip away everyday citizens’ rights to protect themselves and their families. This sudden silence on the topic is no doubt, in part, thanks to the inescapable reality that there are 5-million-plus new gun owners just this year, many of whom are women and minorities.
But they were not so quiet earlier in the campaign, as noted in the new ad, titled “If you're scared that a Biden administration will come for your guns: BINGO, you're right!” After pointing out the violent scenes that have taken place in 2020, the ad says, “Biden and Harris would enact unconstitutional gun-control measures, making it harder than ever to defend yourself. Your family—and rights—won’t be safe in Joe Biden’s America.” The ad then highlights Biden’s “Bingo” answer to an interview question of whether a Biden administration would mean “they are going to come for my guns.”
Of course, Biden hasn’t been totally silent on the topic of guns lately. He once again dangerously suggested in his Oct. 15 “town hall” appearance that “you have to teach people how to de-escalate circumstances. De-escalate. So instead of anybody coming at you and the first thing you do is shoot to kill, you shoot them in the leg.” America’s 1st Freedom pointed out how bad this advice was when Biden first said it last June as a way for police to deal with “an unarmed person coming at ‘em with a knife or something.” Biden’s latest remark has been roundly condemned in interviews with law-enforcement officers and others who actually understand the dynamics of violent encounters.
Biden, of course, has a long history of giving bad firearms advice, like suggesting his wife should fire a shotgun twice in the air on her porch if she were concerned for her safety.
Whether he’s trying to play up his anti-gun leanings or to keep them quiet, it’s obvious that Biden, who is part of the most anti-gun ticket in American history, doesn’t understand or support the right to keep and bear arms. That is a major factor in why the NRA Political Victory Fund endorsed Donald Trump. As this latest Trump ad reminds us, Biden fully intends to strip away Second Amendment rights he hasn’t even taken the time to understand, regardless of how much less safe that might make law-abiding citizens.

Most everyone supports some kind of unconstitutional infringement of the 2nd Amendment.  Like taxes, it's really about where you draw the line.  Democrats draw the line at where it feels good and Republicans draw it according the their authoritarian, blue line views.

They have taken it to some neighborhoods already.

They have gone to some small towns here in Pa and other places and were told to leave by citizens as they wanted no part of their bs

Young gun owners file federal lawsuit challenging age requirement

Three Pennsylvanians are suing the Pennsylvania State Police commissioner because they claim that state statutes prevent them from carrying and transporting firearms in violation of the U.S. Constitution.

The lawsuit requests that state statutes preventing anyone under the age of 21 from obtaining a license to carry a firearm be declared unconstitutional under the Second and Fourteenth amendments.

The lawsuit was filed Friday — with the support of two nonprofits — in federal court in Pittsburgh.

The plaintiffs in the case — Madison M. Lara of Verona, Logan Miller of Boyertown in Berks County and Sophia Knepley of Denver in Lancaster County — are all gun owners below the age of 21.

The two nonprofits involved in the case are the Second Amendment Foundation, based in Bellevue, Wash., and the Firearms Policy Coalition, based in Sacramento, Calif., of which the three plaintiffs are members.

“We’ve filed this action because the situation in Pennsylvania smacks of discrimination against young adults in the 18- to 20-year age group,” said SAF founder and executive vice president Alan M. Gottlieb.

“Young adults can join the military, where they might be assigned to carry firearms all over the world. They can get married, start businesses, enter into contracts and yet they are not considered mature enough to exercise their Second Amendment right to keep and bear arms. That’s nonsense,” he said.

State police Commissioner Col. Robert Evanchick is the sole defendant in the case, according to the lawsuit.

The lawsuit argues that Pennsylvania state law — which prohibits the carrying of firearms on public streets or property during an emergency declared by a state or municipal executive — is in violation of the Second and Fourteenth amendments.

Pennsylvania has been under a state of emergency since January 2018, when Gov. Tom Wolf declared the heroin and opioid epidemic a statewide disaster emergency. The governor also declared a statewide emergency due to the COVID-19 pandemic in March.

The Michael Bloomberg-funded anti-gun groups Moms Demand Action and Everytown unwittingly made the argument why Amy Coney Barrett should be the next Supreme Court Justice.

An Everytown report on Barrett’s dissent in Kanter v Barr states:

Among the first issues that could come before the Supreme Court in upcoming terms are laws regulating the carrying of guns in public, prohibitions on assault weapons and large-capacity magazines, laws restricting the purchase and possession of guns by young people, and laws prohibiting possession by domestic abusers and others with dangerous histories. A new Supreme Court majority could also conceivably change the standard of review in Second Amendment cases, a development that could put nearly every gun law at risk. (Emphasis added)

Erich Pratt, who is the Senior Vice President of Gun Owners of America (GOA), responded:

Moms Demand Action and Everytown’s notion that Amy Coney Barrett could strike down gun control is exactly why we need Barrett on the Court. For far too long, the Supreme Court has refused to take up cases and apply the history, text and tradition of the Second Amendment as well as the Heller and McDonald decisions. Gun owners need a pro-gun majority on the Court that will finally take up and strike down unconstitutional gun control that has been supported by anti-gun judges in the lower courts.

Furthermore, Barrett’s dissent in Kanter demonstrates her strong commitment to the Second Amendment. Aidan Johnston, Director of Federal Affairs of GOA, discussed Judge Barrett’s record on the Second Amendment in a memo, concluding:

Barrett’s dissent from her two Republican-appointed colleagues cited the text and original meaning of the Second Amendment in a bold, uncompromising, and well-researched conclusion, [and it] reveals an unequivocal commitment to the rule of law and an unwillingness to back away from Second Amendment issues due to cowardice, personal preference, or ever-increasing threats by anti-gun politicians…. Gun Owners of America looks forward to the expeditious confirmation of the Honorable Amy Coney Barrett to the Supreme Court of the United States.

What in God’s name do idiots not understand about the last words “shall not be infringed”. I hear all the time that the 2nd Amendment was only meant for musket rifles. Well, the people that say that are dumbasses. Repeating rifles were around in the early 1600’s and yes, if you could afford one, you could own one. So no, our founders were just talking about single shot rifles and pistols.

It’s really simple. Excessive taxes beyond normal sales tax, permits to carry, RED FLAG bullshit, etc......are all infringements.

The 1934 Firearms Act already limited automatic weapons, so the right is apparently not absolute (same as any right).  Most states don't allow concealed carry without a license.

It's all whatever SCOTUS says it is at the time.  We could all say it's all unconstitutional if it makes us feel better, but SCOTUS has ruled otherwise.

I skimmed over the Biden "Plan to END Gun Violence".  It is a round up of the usual suspects, and of course would not even touch the primary area of current gun violence.
